Violation of these prohibitions may result in the immediate termination of your account and access to the Site, and may subject you to civil and/or criminal liability under applicable United States law, including but not limited to the Computer Fraud and Abuse Act (18 U.S.C. § 1030) and the Electronic Communications Privacy Act.

5. Ordering and Payment Terms

5.1 Order Placement and Confirmation

Your order is not confirmed until you receive an electronic order confirmation from us. Risk of loss and title for items purchased pass to you upon delivery of the items to the delivery address you provide.

5.5 Refunds and Cancellations

Due to the perishable nature of food products, all sales are generally final once an order has been accepted and preparation has begun. 6. Intellectual Property Rights

The Site and all of its content, features, and functionality — including but not limited to all text, graphics, logos, images, photographs, icons, audio clips, digital downloads, data compilations, software, and the selection, arrangement, and coordination thereof — are the exclusive property of Jet's Pizza or its licensors and are protected by the intellectual property laws of the United States, including the Copyright Act (17 U.S.C. § 101 et seq.), federal and state trademark laws, and other applicable intellectual property statutes and treaties.

The Jet's Pizza name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Jet's Pizza or its affiliates or licensors. You may not use such marks without the prior written permission of Jet's Pizza. All other names, logos, product and service names, designs, and slogans on this Site are the trademarks of their respective owners.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Site and its content solely for your personal, non-commercial use in connection with our services. This license does not include any right to:

• Resell or commercially exploit the Site or its content;
• Collect and use product listings, descriptions, or prices for competitive purposes;

• Your infringement or misappropriation of any intellectual property right, privacy right, or other right of any third party;

We reserve the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses. We will use reasonable efforts to notify you of any such claim, action, or proceeding upon becoming aware of it.

11. Governing Law and Jurisdiction

These Terms and your use of the Site shall be governed by and construed in accordance with the laws of the United States and the applicable laws of the state in which our primary operations are conducted, without giving effect to any choice-of-law or conflict-of-law provisions.

All legal proceedings arising out of or in connection with these Terms that are not subject to the arbitration provision set forth in Section 12 below shall be brought exclusively in the federal or state courts of competent jurisdiction located within the United States. You hereby consent to personal jurisdiction in such courts and waive any objection as to inconvenient forum.

These Terms shall be interpreted and enforced in a manner consistent with the Federal Trade Commission Act (15 U.S.C. § 41 et seq.) and other applicable federal and state consumer protection laws. Nothing in these Terms shall be interpreted to limit any rights you may have under applicable consumer protection legislation that cannot be lawfully waived by contract.

12. Dispute Resolution and Arbitration

12.1 Informal Resolution

Before initiating any formal legal proceeding, you agree to first contact Jet's Pizza at [email protected] and provide a written description of the dispute, your name, and contact information. We will make reasonable good-faith efforts to resolve the dispute informally within thirty (30) days of receiving your notice. If we are unable to resolve the dispute informally within that period, either party may proceed to formal dispute resolution as described below.

12.2 Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Except for disputes that qualify for small claims court, all disputes arising out of or related to these Terms, the Site, or our services that cannot be resolved informally shall be resolved through binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, which are available at www.adr.org. The arbitration shall be conducted in English, and the arbitrator's decision shall be final and binding on both parties.

The arbitrator shall have the authority to grant any remedy or relief that a court of competent jurisdiction could order or grant, except that the arbitrator may not certify a class or conduct class proceedings. The arbitrator's decision shall be in writing and shall include the essential findings of fact and conclusions of law.

12.3 Class Action Waiver

YOU AND JET'S PIZZA AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and Jet's Pizza agree otherwise, no arbitrator or judge may consolidate more than one person's claims or otherwise preside over any form of representative or class proceeding.

12.4 Exceptions

Notwithstanding the foregoing, either party may seek emergency injunctive or other equitable relief in a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights.

13. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and disclosure of personal information in connection with the Site and our services is governed by our Privacy Policy, available on this Site, which is incorporated into these Terms by reference. By using the Site, you consent to the collection and use of your personal information as described in our Privacy Policy.

We comply with applicable United States federal and state privacy laws, including but not limited to the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA) for California residents, as well as other applicable state and federal privacy statutes. 14. Food Safety and Allergen Notice

Jet's Pizza takes food safety seriously and complies with all applicable federal and state food safety regulations, including those promulgated by the U.S. Food and Drug Administration (FDA) and the U.S. Department of Agriculture (USDA). Our products are prepared in kitchens that handle common food allergens including, but not limited to, wheat, dairy, eggs, soy, tree nuts, peanuts, fish, and shellfish.

While we take reasonable precautions to prevent cross-contamination, we cannot guarantee that any product is completely free from any particular allergen. Customers with known food allergies or specific dietary requirements are strongly advised to contact us directly before placing an order to discuss their needs. Jet's Pizza shall not be liable for any adverse health reactions resulting from the consumption of our food products.

15. Term and Termination

These Terms are effective from the date you first access or use the Site and shall continue in full force and effect until terminated in accordance with the provisions herein.

We reserve the right, in our sole discretion, to terminate or suspend your access to the Site and all or any part of our services, with or without notice and with or without cause, for any reason whatsoever, including but not limited to:

• Unexpected technical or security issues;

All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to: ownership provisions, warranty disclaimers, indemnification obligations, and limitations of liability. We shall not be liable to you or any third party for any termination of your access to the Site or our services.

18. Force Majeure

Jet's Pizza shall not be liable for any delay or failure to perform any obligation under these Terms where such delay or failure results from any cause beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, labor disputes or strikes, governmental actions, embargoes, acts of war or terrorism, civil unrest, power outages, interruptions to internet or telecommunications services, or any other cause beyond our reasonable control (collectively, "Force Majeure Events").

In the event of a Force Majeure Event, our performance obligations shall be suspended for the duration of such event, and we shall use commercially reasonable efforts to resume performance as soon as practicable.

19. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us on the Site, constitute the entire agreement between you and Jet's Pizza with respect to the subject matter hereof and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to the Site and our services.

No oral or written information or advice given by Jet's Pizza, its employees, agents, or representatives shall create a warranty or in any way increase the scope of the warranties expressly set forth in these Terms.

20. Severability

If any provision of these Terms is held by a court of competent jurisdiction or arbitrator to be invalid, illegal, unenforceable, or in conflict with any applicable law or regulation, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms.

The invalidity, illegality, or unenforceability of any provision shall not affect the remaining provisions of these Terms, which shall continue in full force and effect. The parties agree that any invalid or unenforceable provision shall be replaced with a valid and enforceable provision that most closely approximates the intent and economic effect of the original provision.

21. Waiver

No failure or delay by Jet's Pizza in exercising any right, power, or privilege under these Terms shall operate as a waiver thereof. No single or partial exercise of any right, power, or privilege shall preclude any other or further exercise thereof or the exercise of any other right, power, or privilege. Any waiver by Jet's Pizza of a breach of any provision of these Terms shall not be construed as a waiver of any subsequent breach of the same or any other provision.

22. Assignment

You may not assign, transfer, or delegate any of your rights or obligations under these Terms without our prior written consent. Any purported assignment in violation of this section shall be null and void. Jet's Pizza may freely assign or transfer its rights and obligations under these Terms at any time, including in connection with a merger, acquisition, reorganization, sale of assets, or by operation of law, without notice or your consent.

23. No Third-Party Beneficiaries

These Terms are for the sole benefit of you and Jet's Pizza and do not create any third-party beneficiary rights. Nothing in these Terms, express or implied, is intended to or shall confer upon any other person or entity any legal or equitable right, benefit, or remedy of any nature whatsoever under or by reason of these Terms, except as expressly provided herein.
